Wettelijke ondersteuning
De overheid ziet al tijden dat mantelzorg toeneemt, deels als gevolg van de vergrijzing maar ook door maatregelen van de overheid zelf. De “participatiesamenleving” vraagt steeds meer zelfredzaamheid van mensen en zo min mogelijk hulp van de overheid. De aangepaste Wet maatschappelijke ondersteuning is daar een goed voorbeeld van.
Om mantelzorg te stimuleren heeft de landelijke overheid de afgelopen jaren heel wat wetgeving aangepast. Werknemers hebben meer rechten gekregen ten opzichte van hun werkgever, zodat mantelzorg beter te combineren is met een betaalde baan.
Zorgverlof
Sinds 1 juli 2015 gelden verlofregelingen voor een veel grotere groep mensen. Hadden werknemers voorheen alleen recht op zorgverlof voor de verzorging van een kind, een ouder of een partner, nu behoren ook alle huisgenoten, tweedegraads familieleden en iedereen met wie de verlofvrager een sociale relatie heeft tot die groep [1]. Het kan nu dus ook gaan om een buurman of een vriend(in).
Een werkgever mag alleen zorgverlof weigeren als het bedrijfs- of dienstbelang zwaarder weegt dan het zorgbelang van de werknemer. Dat dit ook echt zo is, zal de werkgever in het uiterste geval voor een rechter moeten bewijzen.

Wet flexibel werken
In 2016 is de nieuwe Wet flexibel werken (Wfw) ingegaan. Werknemers hebben daardoor meer mogelijkheden om op flexibele tijden te werken. Ook thuis of elders als dat beter past. Hoewel het woord “mantelzorg” in de uitleg van de Wfw niet wordt genoemd, is de wet wel degelijk bedoeld om ook mantelzorgers extra te steunen.
Werknemers hebben dankzij de Wfw niet alleen vaker recht op een meer flexibele baan, maar kunnen zo’n verzoek ook eerder indienen. Dat kan nu al na een dienstverband van een half jaar (26 weken), in plaats van een jaar zoals voorheen. Een verzoek moet minimaal twee maanden voor de beoogde ingangsdatum zijn ingediend bij de werkgever.
Werkgevers kunnen een verzoek voor flexibeler werk alleen afwijzen als er sprake is van een aantoonbaar, zwaarwegend bedrijfs- of dienstbelang. Bij een afgewezen verzoek kan de werknemer na een jaar een nieuw verzoek indienen. Voorheen zat daar twee jaar tussen.
De Wfw geeft vooral langdurige mantelzorgers meer mogelijkheden om hun zorgtaak met betaald werk te combineren. Een logische voorwaarde is wel dat dat meer flexibiliteit ook binnen de bedrijfsvoering past. Mantelzorg voor een kind is goed met thuiswerken te combineren, maar een fabrieksarbeider is vrijwel altijd fysiek nodig op zijn werk.
Ondersteuning door gemeenten
Als iemand voor ondersteuning vanuit de Wmo aanklopt bij zijn of haar gemeente, doet die tegenwoordig eerst onderzoek naar de mogelijkheden van mantelzorg. Daarmee geeft de Wmo rechtstreeks invulling aan de participatiesamenleving; mensen moeten zo lang mogelijk in de samenleving meedoen zonder overheidssteun. Er vanuit gaande dat deze trend doorzet, neemt de vraag naar mantelzorg en de druk op mantelzorgers de komende jaren alleen maar toe.
De Wmo geeft gemeenten niet alleen het recht om zorg ‘af te houden’: ze zijn ook verplicht om mantelzorg en vrijwilligerswerk in hun gemeente in kaart te brengen, te bevorderen en te ondersteunen. Zorgvragers en mantelzorgers moeten weten welke mogelijkheden de gemeente biedt voor (gratis) ondersteuning. Bij hun onderzoek naar de ondersteuning die iemand nodig heeft, moeten gemeenten ook de mantelzorgers zelf betrekken [2]. Doel is dat zij zelf aan kunnen geven welke ondersteuning bij hun zorgtaken gewenst is. Dit geeft mantelzorgers ook de mogelijkheid om aan te geven hoe zij hun ‘zorgdruk’ ervaren. Het is van belang dat werknemers die mantelzorg leveren, weten dat gemeenten hen kunnen en willen ondersteunen.
Gemeenten moeten in een plan vastleggen hoe zij invulling geven aan de Wmo, maar ze zijn vrij om te bepalen hoe ze mantelzorgers bij hun zorgtaak ondersteunen. Een concreet voorbeeld van gemeentelijke steun is gratis openbaar vervoer voor mantelzorgers met een laag inkomen. Sommige gemeenten bieden mantelzorgers cursussen aan, zorgen voor (extra) huishoudelijke hulp of laten mantelzorgers (deels) gratis parkeren bij het adres waar mantelzorg wordt verleend. Het komt ook voor vrijwilligers worden ingezet om het werk van mantelzorgers te verlichten.
Respijtzorg
Net als werknemers, hebben mantelzorgers soms behoefte aan een paar dagen vrijaf – een behoefte die vaak nog groter is bij mantelzorgers met een betaalde baan. Maar waar vrij nemen van betaald werk wettelijk is geregeld, hebben mantelzorgers zelden vrij. Mantelzorg gaat altijd door.
Steeds meer instanties en organisaties helpen mantelzorgers met “respijtzorg”: vervangende hulp die de mantelzorger even vrijaf geeft van zijn taak. Respijtzorg is er in verschillende vormen. Zo kan degene die mantelzorg nodig heeft tijdelijk elders opgevangen worden, maar het komt ook voor dat een professional of vrijwilliger langsgaat bij de ‘patiënt’.
De Wmo verplicht gemeenten om respijtzorg aan te bieden door deze patiënten kortdurend in een instelling op te vangen [3]. Dit geldt alleen voor mensen die een maatwerkvoorziening vanuit de Wmo krijgen. Maar als iemand volgens de gemeente al voldoende ondersteuning krijgt, bijvoorbeeld door mantelzorgers, hoeft de gemeente geen maatwerkvoorziening te verstrekken. In dat geval kan er ook geen beroep worden gedaan op de Wmo voor respijtzorg voor de mantelzorger.
Wie als mantelzorger wél recht heeft op respijtzorg, kan daar maar beter gebruik van maken. Enkele dagen ‘vrij zijn’ kan de mantelzorger al een hoop ontspanning geven.
Zorgverzekeraars en mantelzorgers
De groeiende aandacht voor mantelzorg is ook veel zorgverzekeraars niet ontgaan. In aanvullende verzekeringen vinden mantelzorgers steeds vaker ondersteuning.
Deze ondersteuning kent verschillende vormen:
- Mantelzorgcursussen waarin de mantelzorger over zorgverlening leert, en waar hij hoort hoe hij zijn grenzen kan bewaken om overbelasting te voorkomen.
- Mantelzorgmakelaars die de mantelzorger helpen met het regelen van allerlei zaken, waaronder het organiseren van de gewenste zorg. Met hun kennis van (wettelijke) regelingen kunnen deze makelaars helpen om de zorgtaak te verlichten.
- Respijtzorg, zodat de mantelzorger er een tijdje tussenuit kan om weer bij te komen.
- Mantelzorg-arrangementen om alleen of met de patiënt buitenshuis op adem te komen.

Ehevertrag
Ein Ehevertrag ist im Grunde genommen ein Vertrag, der das Ehegüterrecht zwischen den Ehepartnern regelt. Er beinhaltet üblicherweise den gewählten Güterstand sowie die Güterverteilung im Rahmen dieses Güterstands. Durch den Abschluss eines Ehevertrags können die Ehepartner geltende Rechtsvorschriften zum beiderseitigen wirtschaftlichen Vorteil an ihre individuellen Bedürfnisse anpassen.
Erbvertrag
Unter einem Erbvertrag versteht man eine vertragliche Vereinbarung zwischen mehreren Personen, welche den Verbleib von Eigentum und Vermögenswerten des Erblassers nach dessen Tod regelt. Der Hauptgrund für einen Erbvertrag ist die Regelung von Erbansprüchen; der Erblasser sagt für die Zeit nach seinem Tod Privilegien zu (Einsetzen von Drittparteien als Erben, Gewähren von Zuwendungen und Erbschaften, d. h. positive Regelungen hinsichtlich der Erbfolge) oder stimmt dem Verzicht auf Erbansprüche zu (beispielsweise dem Verzicht eines Kindes auf seinen Anteil des Nachlasses, Nachlassregelung, d. h. negative Regelungen hinsichtlich der Erbfolge). Ein Erbvertrag wird im Allgemeinen eingesetzt, um die Ansprüche von Nachkommen oder Eltern auf den Pflichtteil zu beschränken, den hinterbliebenen (Ehe-) Partner zu begünstigen oder Erben vollständig auszuschließen, die keinen Anspruch auf einen Pflichtteil besitzen. Analog kann ein Erbvertrag auch eingesetzt werden, um gemeinsames Eigentum vollständig auf den hinterbliebenen Ehepartner zu übertragen.
Der Unterschied zwischen Ehevertrag und Erbvertrag
Im Gegensatz zu einem zwischen den Ehepartnern geschlossenen Ehevertrag sind an einem Erbvertrag neben dem Ehepartner auch andere Personen beteiligt.
Erbverträge müssen im Beisein zweier Zeugen unterzeichnet und als öffentliche Urkunde ausgefertigt werden. Im Gegensatz zu einem Testament kann ein Erbvertrag nicht einseitig aufgehoben werden. Erbverträge können jederzeit durch das schriftliche Einverständnis aller Parteien widerrufen werden (Paragraph 512 ff. Zivilgesetzbuch). Entsprechend müssen auch Änderungen eines Erbvertrags vereinbart werden.
Eheverträge und Erbverträge ergänzen sich im Allgemeinen, allerdings kann sich die Abgrenzung in einzelnen Fällen schwierig gestalten. Je nach der finanziellen Beziehung zwischen den Ehepartnern kann es ratsam sein, sowohl einen Ehevertrag als auch einen Erbvertrag abzuschließen.
Ernennung eines Handlungsbevollmächtigten
Menschen im Vollbesitz ihrer geistigen Kräfte können eine Person ihres Vertrauens benennen, die in ihrem Namen handelt. Die Ernennung eines Handlungsbevollmächtigten kann kostspielige und komplizierte Interventionsmaßnahmen vonseiten der Kindes- und Erwachsenenschutzbehörde (KESB) / Autorité de Protection de l'Enfant et de l'Adulte (APEA) vermeiden.
Die Ernennung eines Handlungsbevollmächtigten ist sowohl für ältere als auch für jüngere Personen geeignet. Die Entscheidungsfähigkeit kann infolge hohen Alters, schwerer Erkrankung oder eines Unfalls verloren gehen. Aus diesem Grund ist es sinnvoll, entsprechend zu planen und dafür zu sorgen, dass Ihre Familie sich um Ihre Angelegenheiten kümmern kann und nicht die Schutzbehörde.
Inhalt einer Handlungsbevollmächtigung
Eine Person kann, solange sie entscheidungsfähig ist, einen Stellvertreter benennen und bevollmächtigen, der sie im Fall ihrer Handlungsunfähigkeit vertritt, ihre Pflege und das Sorgerecht für sie übernimmt und ihre persönlichen Angelegenheiten und Vermögenswerte verwaltet. Bei der Ernennung zum Handlungsbevollmächtigten handelt es sich um einen Vertrag. Indem die ernannte Person die Ernennung zum Handelsbevollmächtigten annimmt, verpflichtet sie sich zur Ausführung der ihr übertragenen Aufgaben.
- Pflege und Sorgerecht
- Unter Pflege und Sorgerecht ist die Betreuung der persönlichen Angelegenheiten der handlungsunfähigen Person zu verstehen. Dazu gehört die Entscheidung über die medizinische Versorgung der Person und die alltäglichen Bedürfnisse und Hilfestellungen.
- Finanzangelegenheiten
- Der ernannte Stellvertreter ist bevollmächtigt, sich um Einkommen, Vermögenswerte und finanzielle Angelegenheiten der handlungsunfähigen Person zu kümmern. Dazu gehören die Verwaltung ihrer Vermögenswerte, die Begleichung von Rechnungen und die Bearbeitung sonstiger finanzieller Verpflichtungen.
- Rechtsbeziehungen
- Die Handlungsbevollmächtigung besitzt hinsichtlich der Rechtsbeziehungen mit Versicherern, öffentlichen Behörden sowie privaten und öffentlichen Einrichtungen Gültigkeit. Der Handlungsbevollmächtigte kann Vereinbarungen und vertragliche Verpflichtungen im Namen der handlungsunfähigen Person rechtsgültig abschließen und auflösen.

Il contient généralement le type de régime matrimonial choisi, ainsi que la distribution des biens immobiliers au sein de ce régime. Contrat de succession
Un contrat de succession est un accord contractuel entre plusieurs personnes qui régit la répartition des biens immobiliers et des actifs après le décès du testateur. L’objectif principal d’un contrat de succession est de réglementer les réclamations d’héritage. Le testateur promet des privilèges après son décès (en désignant des tiers comme héritiers, en faisant des legs et des dons testamentaires, soit des accords d’attribution) ou accepte la renonciation à l’héritage (par exemple, un enfant renonce à sa part de la succession, des règlements de succession, soit des accords de renonciation). Un contrat de succession est généralement utilisé pour limiter les réclamations des descendants ou des parents pour ce qui est de la part obligatoire en faveur du conjoint survivant ou pour totalement exclure les héritiers qui n’ont aucun droit à une part obligatoire. De même, un contrat de succession peut servir à assurer le transfert de la propriété complète d’un bien commun au conjoint survivant.
Différences entre les deux types de contrat
Contrairement à un contrat de mariage conclu entre conjoints, un contrat de succession implique d’autres personnes en plus du conjoint.
Les contrats de succession doivent être signés devant deux témoins et exécutés comme un acte public. Contrairement à un testament, un contrat de succession ne peut pas être résilié unilatéralement. Les contrats d’héritage peuvent être révoqués à tout moment par un accord écrit de toutes les parties (Article 512 et suivants du code civil). De même, tout amendement doit être accepté dans un contrat de succession.
Les contrats de mariage et de succession sont généralement complémentaires, mais il peut parfois être difficile de les délimiter dans certains cas individuels. Selon la relation financière qui existe entre les conjoints, il peut être judicieux de conclure un contrat de mariage et un contrat de succession.
Désignation d’un fondé de pouvoir

Contenu d’une désignation d’un fondé de pouvoir
Une personne capable de prendre ses propres décisions peut désigner et habiliter un fondé de pouvoir pour la représenter, assumer ses soins et sa garde et gérer ses affaires et actifs personnels en cas d’incapacité civile. La désignation d’un fondé de pouvoir constitue un contrat. En acceptant cette désignation, la personne désignée s’engage à exercer les fonctions qui lui sont confiées.
- Soin et garde
- Cela revient à s’occuper des affaires personnelles de la personne incapable. Cela inclut la prise de décisions relatives aux soins médicaux de cette personne, ainsi qu’à ses besoins et au soutien dont elle a besoin au quotidien.
- Affaires financières
- Le fondé de pouvoir désigné est habilité à s’occuper des revenus, des actifs et des affaires financières de la personne incapable. Cela inclut la gestion de ses actifs, le paiement des factures et la gestion des autres obligations financières.
- Relations juridiques
- La validité du fondé de pouvoir est reconnue dans les relations légales avec les compagnies d’assurance, les bureaux de l’administration publique, ainsi que les institutions privées et publiques. La personne désignée peut dûment signer et résilier des contrats et des obligations contractuelles au nom de la personne incapable.
Accordo prematrimoniale
Fondamentalmente un accordo prematrimoniale è un contratto che disciplina i diritti patrimoniali dei coniugi. In genere, prevede la scelta tra un regime patrimoniale condiviso tra i coniugi e la divisione dei beni all’interno di tale regime. Stipulando un accordo prematrimoniale, i coniugi possono adattare le disposizioni di legge alle loro personali esigenze ed offrire indennità finanziarie reciproche.
Contratto successorio
Un contratto successorio è un accordo contrattuale tra più soggetti che disciplina la distribuzione dei beni patrimoniali dopo la morte del testatore. Lo scopo principale di un contratto successorio è quello di disciplinare le pretese ereditarie; il testatore promette dei privilegi dopo la sua morte (nominando eredi dei soggetti terzi, garantendo lasciti ed eredità; per esempio patti successori positivi), oppure accetta la rinuncia delle pretese ereditarie (per esempio, un bambino che rinuncia ad una quota ereditaria o accordi ereditari; per esempio patti successori negativi). Il contratto successorio normalmente viene usato per limitare le pretese dei discendenti o dei parenti nei confronti della quota obbligatoria, a favore del coniuge superstite, oppure per escludere completamente gli eredi che non hanno diritto ad una quota obbligatoria. Analogamente, un contratto successorio può essere usato per prevedere il trasferimento al coniuge superstite della piena proprietà di un patrimonio comune.
Differenze tra i due tipi di contratto
Diversamente da un accordo prematrimoniale stipulato tra i coniugi, un contratto successorio coinvolge altri soggetti oltre al coniuge.
I contratti successori devono essere sottoscritti dinanzi a due testimoni e stipulati come un atto pubblico. Diversamente da un testamento, un contratto successorio non può essere annullato unilateralmente. I contratti successori possono essere revocati in qualsiasi momento mediante accordo scritto di tutte le parti (articoli 512 e successivi del codice civile). Analogamente, in un contratto successorio anche le modifiche devono essere concordate.
In genere, gli accordi prematrimoniali e i contratti successori sono complementari, ma la linea di demarcazione tra i due può essere difficile a seconda dei casi specifici. In base ai rapporti finanziari tra i coniugi, può essere consigliabile stipulare sia un accordo prematrimoniale che un contratto successorio.
Designazione di una procura
Le persone capaci di intendere e di volere possono nominare un soggetto di cui si fidano affinché operi per loro conto. La designazione di una procura può essere utile ad evitare interventi costosi e complicati della commissione per la protezione dei minori e degli adulti (KESB/APEA).
La designazione di una procura è adatta sia per i soggetti anziani che giovani. Con l’età, a causa di patologie o incidenti, è possibile perdere le proprie facoltà mentali. Quindi, è saggio mettere a punto un piano strategico per assicurarsi che siano i propri familiari ad occuparsi delle proprie questioni e non la commissione per la protezione.

Una persona in possesso delle sue facoltà mentali può nominare e conferire ad un procuratore il potere di rappresentarla, di farsi carico della sua cura e custodia e di gestire le sue questioni e i suoi beni personali in caso di incapacità ad agire. La designazione di una procura è un contratto. Accettando la nomina, la persona designata si assume l’esercizio dei doveri che le sono stati affidati.
- Cura e custodia
- Con l’espressione cura e custodia si intende il prendersi carico delle questioni personali del soggetto dichiarato incapace, come prendere decisioni sulle cure mediche e sulle esigenze quotidiane della persona in questione e sulla relativa assistenza.
- Questioni finanziarie
- Il procuratore nominato ha l’incarico di prendersi cura del reddito, del patrimonio e delle questioni finanziarie del soggetto dichiarato incapace, come per esempio gestire il patrimonio, pagare i conti ed occuparsi di altri obblighi finanziari.
- Rapporti giuridici
- La procura è valida nei rapporti giuridici con assicuratori, pubblica amministrazione ed istituzioni pubbliche e private. Il procuratore nominato può stipulare e porre fine validamente ad accordi ed obblighi contrattuali per conto del soggetto dichiarato incapace.
